Article 1 (Purpose)

These terms and conditions are the rights of the cyber mall and users to use the Internet related services (hereinafter referred to as “services”) provided by XM Cyber Mall (hereinafter referred to as “mall”) operated by XM (e-commerce company). For the purpose of defining obligations and responsibilities.
※ ``This agreement applies to e-commerce using PC communications, wireless, etc., unless contrary to its nature.''



Article 2 (Definition)

① “Mall” refers to a virtual business place set up by XM Corporation to trade goods or other information using computer and information communication facilities to provide goods or services (hereinafter referred to as “goods”) to users. In addition, it is also used as a business operator operating a cyber mall.
② “User” means a member who accesses the “mall” and receives the services provided by the “mall” in accordance with these terms and conditions.
③ “Member” refers to a person who has registered as a member of the “Mall” and can continuously use the services provided by the “Mall”.
④ “Non-member” refers to a person who uses the services provided by the “Mall” without registering for membership.



Article 3 (Specification, explanation and revision of terms and conditions)

① “Mall” includes the contents of this agreement, the name of the company and the representative, the address of the place of business (including the address where the customer can handle the complaint), phone number, copy number, e-mail address, business registration number, communication We post on the initial service screen (front) of 00 Cyber Mall so that users can easily know the sales number, personal information protection officer, etc. However, the contents of the terms and conditions can be made available to users through the connection screen.
② “Mall confirms the user by providing a separate connection screen or pop-up screen so that the user can understand important contents such as subscription withdrawal, delivery responsibility, and refund terms among the contents specified in the agreement before the user agrees to the agreement. ③ “Mall” refers to the 「Act on Consumer Protection in Electronic Commerce, etc.」, 「Act on the Regulation of Terms and Conditions」, 「Basic Act on Electronic Documents and Electronic Transactions」, 「Electronic Financial Transaction Act」, 「Electronic Signature Act」, and 「Information Communication Network」 You can revise these terms and conditions to the extent that they do not violate related laws such as the Act on Promotion and Information Protection, the Act on Visit and Sell, and the Basic Act on Consumers.
④ When the “Mall” revises the Terms and Conditions, the date of application and the reason for the revision are specified, and the current terms and conditions are notified on the initial screen of the Mall from 7 days before the date of application to the day before the date of application. However, if the terms and conditions are changed against the user, the notice will be given at least 30 days in advance. In this case, the “Mall” clearly compares the content before and after the revision and displays it for the user to understand.
⑤ When the “Mall” revises the terms and conditions, the revised terms and conditions apply only to the contracts concluded after the effective date, and the terms and conditions of the terms and conditions before the revisions are applied to the contracts already concluded before that. However, if the user who has already signed the contract wants to be subject to the provisions of the revised terms and conditions to the “mall” within the notice period of the revised terms and conditions under paragraph 3, the terms of the revised terms and conditions apply. ⑥ Regarding matters not specified in this agreement and interpretation of these agreements, please refer to the Consumer Protection in Electronic Commerce Transactions Act, Regulations of the Agreement, Consumer Protection Guidelines in Electronic Commerce, etc. as determined by the Fair Trade Commission and related laws or related practices. Article 4 (Service Provision and Change)

① “Mall” performs the following tasks.
  1. Provision of information on goods or services and conclusion of a purchase contract
  2. Delivery of goods or services for which a purchase contract is concluded
  3. Other “Mall” duties
② “Mall” may change the contents of goods or services to be provided by a contract to be concluded in the event of a sellout of goods or services or a change in technical specifications. In this case, the contents and date of delivery of the changed goods or services are specified and immediately notified where the contents of the current goods or services are posted.
③ When the contents of the service contracted by the user to be provided by the “Mall” are changed for reasons such as out of stock, such as goods, or changes in technical specifications, the reason is immediately notified to the address that can notify the user.
④ In the case of the preceding paragraph, the “Mall” compensates the user for damages. However, this is not the case when the “Mall” proves that there is no intention or negligence.



Article 5 (Suspension of Service)

① The “Mall” may temporarily suspend the provision of services in the event of reasons such as maintenance checks, replacements and breakdowns of computers and information and communication facilities, and loss of communication.
② The “Mall” compensates for damages suffered by users or third parties due to the temporary suspension of service provision for the reason of paragraph 1. However, this is not the case when the “Mall” proves that there is no intention or negligence.
③ In the event that the service cannot be provided due to the conversion of business items, abandonment of business, integration between companies, etc., the “Mall” notifies the user in the manner specified in Article 8 and according to the conditions originally set out in the “Mall” Rewards. However, if the “Mall” does not notify the compensation standards, etc., the mileage or reserves of the users are paid to the user in kind or cash corresponding to the currency value used in the “Mall”.



Article 6 (Member Registration)

① The user applies for membership by filling out the member information according to the registration form set by the “Mall” and expressing his intention to agree to these terms.
② “Mall” is registered as a member of the users who applied to join as a member as described in Paragraph 1, unless they fall under any of the following items.
  1. If the applicant for membership has previously lost membership under Article 7 (3) of these Terms and Conditions, however, three years have elapsed since the loss of membership under Article 7 (3) and consent to membership re-entry of the “Mall” An exception is made when.
  2. If there is false information, omission, or error in registration
  3. If it is judged that the registration of other members is significantly impeded by the technology of the “Mall”
③ The time of establishment of the membership subscription contract is when the acceptance of the “Mall” reaches the member.
④ If there is a change in the registered information at the time of membership registration, the member must notify the “Mall” of the change in a manner such as amendment of member information within a considerable period of time.



Article 7 (Withdrawal of Membership and Loss of Qualification, Etc.)

① Members can request the withdrawal at any time to the “Mall”, and the “Mall” immediately processes the withdrawal of the membership.
② If the member falls under any of the following reasons, the “Mall” may restrict and suspend membership.
  1. When false information is registered at the time of application
  2. In the event that the member's debts related to the payment of goods purchased using the “Mall” or other “Mall” are not paid on a due date
  3. In the case of threatening the e-commerce order, such as interfering with the use of other people's "mall" or stealing the information
  4. In the case of using the “Mall” to violate laws and regulations or to violate public order and morals
③ After the “Mall” restricts or suspends membership, the “Mall” may lose membership if the same act is repeated more than once or the reason is not corrected within 30 days.
④ In the event that the “Mall” loses membership, the membership registration is cancelled. In this case, the member is notified of this, and a period of at least 30 days prior to the cancellation of membership registration is set to give an opportunity to call.



Article 8 (Notification to Members)

① When the “Mall” notifies the member, the member can make an email address specified in advance with the “Mall”.
② “Mall” can replace individual notices by posting on the “Mall” bulletin board for more than one week in the case of notice to unspecified members. However, individual notices are given for matters that have a significant impact on the member's transaction.



Article 9 (Purchase Application)

① The “Mall” user applies for the purchase on the “Mall” by the following or similar method, and the “Mall” must provide each of the following in an easy-to-understand manner when the user applies for the purchase.
  1. Search and select goods
  2. Enter the recipient's name, address, phone number, e-mail address (or mobile phone number), etc.
  3. Confirmation of the contents related to the cost burden, such as the terms and conditions, services for which subscription rights are restricted, delivery charges, and installation costs.
  4. A sign to agree to these terms and conditions, or to confirm or deny the above (3)
  5. Application for purchase of goods, etc. and consent to confirmation of this or confirmation of “Mall”
  6. Selection of payment method
② If the “Mall” needs to provide and entrust the purchaser's personal information to a third party, the purchaser's consent must be obtained at the time of the actual purchase application. At this time, the “Mall” must specify to the purchaser the items of personal information provided, the recipient, the purpose of using the personal information of the recipient and the period of retention and use. However, if there are other stipulations in the relevant laws and regulations, such as in the case of entrustment of personal information processing pursuant to Article 25 (1) of the 「Act on Promotion of Information and Communication Network Utilization and Information Protection, etc.」



Article 10 (Establishment of Contract)

① “Mall” may not approve the purchase request as in Article 9 if it falls under any of the following items. However, if you sign a contract with a minor, you must notify the minor or the legal representative that you can cancel the contract if you do not get the consent of the legal representative.
  1. If there is false information, omission, or error in the content of the application
  2. When a minor purchases goods and services prohibited by the Youth Protection Act, such as tobacco and alcohol.
  3. If it is judged that the acceptance of the other purchase application is significantly impeded by the “mall” technology
② It is assumed that the agreement has been established when the acceptance of the “Mall” reaches the user in the form of an acknowledgment notice in Article 12 (1).
③ The “Mall”'s intention to approve should include information on the user's purchase application confirmation and availability, and the cancellation of the purchase application.



Article 11 (Payment Method)

The payment method for goods or services purchased in the “Mall” can be made using any of the following methods. However, the “Mall” cannot collect any nominal fees in addition to the payment of goods for the user's payment method.
1. Various account transfers such as phone banking, internet banking, and mail banking
2. Payment of various cards such as prepaid cards, debit cards, and credit cards
3. Online bankbook deposit
4. Payment by electronic money
5. Payment upon receipt
6. Payment by points paid by “Mall” such as mileage
7. Payment with a gift certificate signed by the “Mall” or recognized by the “Mall”
8. Payment by other electronic payment methods, etc.



Article 12 (Notification of Receipt, Change and Cancellation of Purchase Application)

① “Mall” notifies the user of receipt if there is a purchase request from the user.
② In the event that there is a discrepancy in the intention of receipt, the user who has received the confirmation of receipt can request to change or cancel the purchase application immediately after receiving the confirmation of receipt, and the “Mall” requests without delay if requested by the user before delivery. Should be processed according to However, if payment has already been made, it is subject to the provisions of Article 15 withdrawal of subscription.



Article 13 (Supply of Goods, Etc.)

① “Mall” will take other necessary measures such as custom-made, packaging, etc. so that goods can be shipped within 7 days from the date of subscription, unless there is a separate agreement regarding the supply time of users and goods. . However, if the “Mall” has already received all or part of the price of goods, etc., it will take action within 3 business days from the date of receiving all or part of the price. At this time, the “Mall” takes appropriate measures so that the user can check the supply procedure and progress of goods.
② “Mall” specifies the delivery method, the delivery cost bearer for each method, and the delivery period for each method for the goods purchased by the user. If the “Mall” exceeds the agreed delivery period, the user's damages must be compensated. However, this is not the case when the “Mall” proves that there is no intention or negligence.



Article 14 (Refund)

The “Mall” shall notify the user of the reason without delay when the goods, etc. that the user has applied for purchase cannot be delivered or provided for reasons such as out of stock, and if the goods are received in advance, 3 Reimbursement within the business day or take necessary action for reimbursement.



Article 15 (Withdrawal of Subscription, Etc.)

① The user who has entered into a contract for the purchase of goods, etc., with the “Mall” is the day the document was received in accordance with Article 13, Paragraph 2 of the 「Act on Consumer Protection in Electronic Commerce, etc. C. If the supply of goods, etc. is made late, it is possible to withdraw the subscription within 7 days from the date on which goods are supplied or the supply of goods, etc. has started. However, if there is a different provision in the 「Act on Consumer Protection in Electronic Commerce, etc.」 regarding withdrawal of subscription, the provisions of the Act shall be followed.
② When a user receives goods, etc., he/she cannot return or exchange goods in the following cases.
  1. When goods, etc. are lost or damaged due to the user's responsibility (however, if the packaging, etc. is damaged in order to check the contents of goods, the subscription may be withdrawn)
  2. The value of goods, etc. has decreased significantly due to the user's use or consumption.
  3. When the value of goods, etc. has decreased significantly to the extent that it is difficult to resell over time
  4. When it is possible to reproduce the goods with the same performance, the packaging of the original goods, etc. is damaged.
③ In the case of subparagraphs 2 to 4 of the subparagraph 2, if the “Mall” does not specify where the consumer can easily withdraw the subscription in advance or provide a trial product, etc., the user may withdraw the subscription. There are no restrictions.
④ In spite of the provisions of paragraphs 1 and 2, if the contents of goods, etc. are different from those displayed or advertised or implemented differently from the contract, within 3 months from the date of receipt of the goods, etc. Alternatively, you can withdraw your subscription within 30 days from the date you noticed it.



Article 16 (Effect of Withdrawal of Subscription, Etc.)

① “Mall” will refund the amount of goods already paid within 3 business days when goods are returned from the user. In this case, when the “Mall” delays the refund of goods, etc. to the user, the delay period is calculated by multiplying the delayed interest rate (deleted in parentheses) specified in Article 21-2 of the 「Enforcement Decree of the Consumer Protection Act in Electronic Commerce, etc.」 Deferred interest is paid.
② In the “Mall”, when the user pays for goods such as credit cards or electronic money in the refund of the above payments, the company that provided the payment method without delay immediately stops claiming the goods. Or ask to cancel.
③ In the case of withdrawal of subscription, the user is responsible for the cost of returning the goods received. The “Mall” does not charge the user for a penalty or damages for reasons such as withdrawal of subscription. However, if the contents of the goods, etc. are different from the contents of the indication and advertisement, or the contents of the contract are different, and the subscription is withdrawn, the cost required for the return of the goods, etc. is paid by the “Mall”.
④ When the user bears the shipping cost when receiving goods, etc., the “Mall” clearly indicates to the user who is paying the cost when the subscription is withdrawn.



Article 17 (Personal Information Protection)

① “Mall” collects the minimum personal information to the extent necessary for providing services when collecting user's personal information.
② “Mall” does not collect the information necessary to fulfill the purchase contract in advance when registering for membership. However, this is not the case when personal identification is required prior to the purchase contract in order to fulfill the obligations in accordance with the relevant laws and where at least certain personal information is collected.
③ When the “Mall” collects and uses the user's personal information, it notifies the user of the purpose and receives the consent.
④ The “Mall” cannot use the collected personal information for any purpose other than the purpose. When a new purpose of use occurs or when it is provided to a third party, the user is notified of the purpose and consent is obtained during the use and provision phase. However, there are exceptions in cases where the related laws and regulations stipulate otherwise.
⑤ When the “Mall” must obtain the user's consent under paragraphs 2 and 3, the identity of the person in charge of personal information protection (affiliation, name and phone number, other contact information), purpose of collecting and using information, and third The provisions of Article 22 (2) of the 「Act on Promotion of Information and Communication Network Utilization and Information Protection, etc.」, such as matters related to the provision of information to persons (recipients, purpose of providing and information to be provided), must be specified or notified in advance and users May withdraw this consent at any time.
⑥ Users may request to read and correct errors in their personal information held by the “Mall” at any time, and the “Mall” is obliged to take necessary measures without delay. If the user requests to correct the error, the “Mall” will not use the personal information until the error is corrected.
⑦ In order to protect personal information, the “Mall” must limit the number of users who process personal information to the minimum, and the loss, theft, leakage of personal information of users, including credit cards, bank accounts, etc. We take full responsibility for damages caused by users.
⑧ “Mall” or a third party who receives personal information from it, destroys the personal information without delay when it has achieved the purpose of collecting or providing personal information.
⑨ “Mall” does not set the consent column regarding the collection, use, and provision of personal information as a pre-selected one. In addition, the service that is restricted when the user refuses to consent to the collection, use, and provision of personal information is specifically specified, and services such as membership registration due to the user's refusal to consent to the collection, use, and provision of personal information that are not mandatory collection items We do not limit or decline offers.



Article 18 (Obligations of the “Mall”)

① “Mall” shall not do anything that is prohibited by the law and this Agreement or contrary to public order and morals, and must do its best to provide goods and services consistently and stably, as prescribed by this Agreement.
② “Mall” must have a security system to protect users' personal information (including credit information) so that users can safely use the Internet service.
③ The “Mall” is responsible for reimbursing the user for damages caused by improper labeling and advertisements prescribed in Article 3 of the 「Act on Fairness of Labeling and Advertising」 for products and services.
④ “Mall” does not send commercial e-mail for commercial purposes that users do not want.



Article 19 (Obligations for Member ID and Password)

① Except in the case of Article 17, the member is responsible for the management of ID and password.
② Members should not let their third parties use their ID and password.
③ If a member recognizes that his ID and password are stolen or used by a third party, he/she must immediately notify the “mall” and follow the “mall” instructions.



Article 20 (Obligations of Users)

The user should not conduct the following.
1. Registration of false information when applying or changing
2. Theft of information of others
3. Change of information posted on the “Mall”
4. Transmission or posting of information (computer programs, etc.) other than the information specified by the “Mall”
5. Infringement of intellectual property rights such as copyright of the “Mall” or other third parties
6. Any act that damages the reputation of the “Mall” or other third parties or interferes with business
7. Disclosing or posting obscene or violent messages, images, voices, or other information contrary to public order and morals



Article 21 (Relationship Between the Linking “Mall” and the Linked “Mall”)

① When the upper “mall” and the lower “mall” are connected in a hyperlink (eg, the target of the hyperlink includes text, pictures, and moving images), etc., the former is called the linking “mall” (website) and the latter It is called the "Mall" (website) to be connected.
② In the case of the connection “mall”, it means that the connection “mall” does not take responsibility for guarantees for transactions conducted with the user due to the goods provided independently, etc. We are not responsible for the warranty of the transaction.



Article 22 (Attribution of Copyright and Restrictions on Use)

① Copyright and other intellectual property rights to works created by the “Mall” shall belong to the “Mall”.
② The user may use the information provided by the “Mall” to which the Intellectual Property Rights belong to the “Mall” for commercial purposes by copying, sending, publishing, distributing, broadcasting or other methods without prior consent of the “Mall” You shouldn't let them use it.
③ “Mall” must notify the user in case of using the copyright belonging to the user according to the agreement.



Article 23 (Dispute Resolution)

① “Mall” installs and operates a damage compensation mechanism to reflect legitimate opinions or complaints raised by users and to compensate for the damage.
② “Mall” handles complaints and opinions submitted by users with priority. However, if prompt processing is difficult, the user is immediately notified of the reason and schedule.
③ In the event of a user's request for remedy related to an e-commerce dispute between the “Mall” and the user, it may be subject to mediation by the Fair Trade Commission or a dispute mediation agency commissioned by the provincial/province governor.



Article 24 (Jurisdiction and Governing Law)

① The lawsuit regarding the e-commerce dispute between the “Mall” and the user is based on the address of the user at the time of filing, and if there is no address, the district court, which has jurisdiction over the place of residence, shall have full jurisdiction. However, if the address or residence of the user is not clear at the time of the complaint, or if the person is a foreign resident, it is filed with the competent court under the Civil Procedure Act.
② Korean law applies to e-commerce lawsuits filed between the “Mall” and users.
